Canada new immigration law
is effective from now on. I
have read the following question
and the answer from your website:
"Question: Since our friends
told us that there is no 183
days limitation under the new
law which is staying 2 years
during 5 years period. Even
we passed the 183 days period,
we are still valid for Canada
PR. Is this correct? Should
we go back to Canada before
June 28, 2002 or after that
date? Lots of friends applied
for Canada PR but still work
in US. Since the declining economy
in US, we all want to keep our
Canada PR status just in case.
Please give me some advises.
Also do you have a branch in
Toronto? We really need some
advises for applying for the
citizenship of Canada.
Answer: You should return to
Canada IF your stay in US will
be over 6 months before June
28th. You will be eligible to
apply for Canadian citizenship
if you have lived in Canada
for over 3 years in the past
4 years prior to the date of
your application. Our Toronto
Office's contact phone number
is 416-593-8008."
My question is:
Q1: Why the Canadian PR should
return to Canada before June
28 if he lived outside Canada
for more than 183 days but less
than 3 years? The new law is
working now, which demand Canadian
PR to live in Canada for only
2 years in each 5 years.
A1: Your stay outside Canada
should NOT exceed 183 days before
June 28th according to the old
immigration law. Your PR status
must be valid when applying
the new law. You don't have
to return to Canada if your
stay outside Canada does not
exceed 183 days before June
28th.
